Sorry, My Mother Has All Our Money!
|
In some instances, houses are bought on joint names of husband and wife. Sometimes women are shown as business partners on paper to save taxes. Once in a blue moon a small piece of land is gifted to a married woman either by her father or husband.
But Imagine a scenario where all the property is owned by a middle aged Gujarati housewife, and that too when her husband and son are alive and active. Are you joking?
But joke or not, the Patels got away with it.
Of course they are not the first one to play this game. We have seen many cases before this where, as soon as the marital dispute threatens to reach the court, the man's lawyers swing in action. Properties start changing hands rapidly on paper. Rich man becomes legally poor.
When the time comes to decide maintenance amount for the wife and children in such cases, the man says that his financial condition can't let him pay much maintenance to the wife and children. His lawyer produces the documents that show that the house where he stays belongs to his mother, business to his father, jewellery to his sister... in short the man himself owns very little.
Sometimes this ploy works. The divorced wife of a legally poor, rich man may end up receiving peanuts as maintenance.
According to an eminent lawyer, if the property is transferred on other person's name within two years of filing the divorce case, it can be challenged. But he also shows how easy it is to produce back dated documents. Is it possible this is what happened in Sonal's case?
The court in its infinite wisdom must have checked all the angles before arriving at the judgement. But still, it doesn't change the fact that innumerable males take advantage of such legal loopholes to escape financial responsibilities towards their wife and children.
Should a girl now, before getting married check the prospective groom's independent financial status? Ask Sonal and other women like her, who perhaps married into rich families and are now living as poor divorcees.
