Registered Marriage
Priya asks,
I am planning to get married in a registered marriage office in Kerala. My fiancé is 22 yrs (Christian) and I am 18 (Hindu). Both of us are NRI's staying in Qatar. So is there any legal barrier for us in getting married and are there any documents like the identity card or passport or anything like that we need to produce as a proof of our age or is producing the copies of any of the above stated instead of original permitted? Will there be any problem from the legal side for such a register marriage? If so how can it be solved?
Dear Priya,
As per the limited facts as narrated by you, you can definitely get married to your proposed spouse in India and get the marriage registered in India under the provisions of Special Marriage Act 1954 by following a systematic procedure as laid down by the law. The Special Marriage Act, 1954 requires certain preliminaries to the solemnisation of marriage. It should be kept in view that marriages under the Act are essentially civil marriages, and the Act provides for civil formalities.
Notice of marriage and its publication - As stated in earlier answer
Solemnisation of marriage - As stated in earlier answer.
In addition, both of you need to get the documents listed above.
Hope this should suffice your query in brief.
Second Marriage
Veenapani asks,
I am a 45 yrs divorcee, with two children who are in their father's custody but can visit me. I have a proposal from a 56 yr widower. According to his son, I have to sign an agreement to the effect that I will not claim any right over his earnings and property and I have to shift to a portion of his house. Verbally, they have no objection with my children visiting me. They want this agreement to be registered. I want to know what is the role of the second wife regarding her husband's property especially when she has children (there will always be the fear of her shifting the property to her own children if she gets it).
Dear Veenapani,
You have not mentioned under which personal law you are intending to get married. You have not clarified as per which religion you and your proposed spouse profess. In brief, marriage is not a contract as per Indian legislation. If both, you and your proposed spouse's status is cleared before marriage, then you can definitely get married under the governance of Indian legislation and you shall enjoy all the rights of a wife and a family member as per law in brief. You may consult an expert family lawyer with regards any other compliances if necessary. Hope this should suffice your query in brief.
Marriage Certificate
Shailesh asks,
I am working in USA and my wife is staying in India. I would like to apply for marriage certificate in Bangalore. But at registration office, they are asking for address proof. I am providing bank statement as address proof. Since my wife is living in a rented house, we cant provide electricity bill or phone bill. Please suggest me how to get marriage certificate. Can I register my marriage in Indian Embassy USA?
Dear Shailesh,
Yes, you can definitely register your marriage at the office of marriage registrar situated at the place of jurisdiction where your marriage has taken place. You may request your wife to visit the office of marriage register and do the appropriate compliances as required. If required then you may give them joint declaratory affidavit duly notarised stating about your marriage and the residential arrangement along with the bank statements. Hope this should suffice your query.
