I am going to get married to a woman from India in February 2006. I have heard that the law is changing in India and that soon you will only be allowed to marry a woman who is 24 years or older, is this true, when will it happen?

Dear Mandeep,
One of the conditions for a valid marriage under Indian laws is that the bridegroom must have completed twenty one years of marriage and the bride, the age of eighteen years at the time of marriage. I hope this shall suffice your query.

I wish to get divorced

Satish asks,
I got married to a girl in Hyderabad in December 2004 under the Hindu Marriage Act. I left to Australia one week after that. We have never lived together. I wish to get divorced now. I can not make frequent trips to India due to the non-availability of time. She has never been to the Australia. Can I file for a divorce in Australia and send her a notice for the same? What would be the fastest way to obtain a divorce? Will it be a good option for her to file a divorce under ex parte? Is it possible for a lawyer to represent me in the court of Hyderabad if I issue a power of attorney? Is there a possibility to expedite a divorce by paying a higher amount of money to the court? What are my chances of getting a divorce from Australia if she doesn't wish to cooperate? Would it require me making many trips for this? Is this a faster way?

Dear Satish,
You will have to file your papers seeking divorce in India at the place of the jurisdiction where your marriage was duly registered or at the place of jurisdiction where our wife resides currently. You will have to remain present before the court at the time of your proceedings as and when the hearing is placed before the Family Court. You will have to follow the due processes of the legislation.
