Abusing Husband

Vashishth asks,
I am married for the past 5 1\2 years and blessed with a son aged 2 1/2 years. From the start the marriage was not peaceful and now it is really humiliating to be thrashed by my so educated husband every now and then. I want to live separately with my son (I was working till the time of birth of my son but not now). I am planning to work again so that I can be financially independent. Please advise me the legal procedure I should follow. Also I need the compensation of what all dowries I have bought with me. Kindly advise.
Dear Vashishth,

You can definitely initiate legal process by taking appropriate legal steps by filing petition for divorce on the grounds of mental and physical cruelty caused to you. You may also take out application for appropriate child custody as per law. You may initiate the same at the forum of the place where you are presently residing. You may consult a divorce lawyer who may assist you with the required further compliance as sought by you.

Hope this should clarify your query in brief.

Concerned Father

Kishore Kumar asks,
My child (boy) is 3 years old and he is living in my wife's house with her parents. He is going to school. My wife is working and earning around ten thousand per month. She had applied for interim maintenance for her and child (six thousand each). I want to take the custody (Physical & Legal) of the child. Is it possible for me get the custody at this stage and whether I have to pay my wife as well? I am earning around thirty five thousand. Also she is training the child against me.
Dear Kishore Kumar,
