Legalisation of marriage certificate

Mahesh asks,
I got married in 1992 in Mumbai, got it registered in 1993. Both of us are Hindu. I want to apply for legalisation of my marriage certificate by Foreign Embassy. My wife changed her name from maiden to married. Is it necessary to register the change of her name from maiden to married due to marriage in official Gazette?
Dear Mahesh,

What we suggest to you is that you keep the same name as entered in the marriage certificate for the appropriate legalisation and submit the same to the appropriate foreign embassy along with the Marriage Registration certificate. If your wife wants to keep the new married name then the change of name procedure in the official gazette is mandatory.

Different marriage Acts

Rosh asks,
My fiancé and me want to get married at the earliest. I am a Christian and she is a Hindu. I am in UK at the moment and my fiancé is in India. I wanted to know if we can marry under the Special Marriage Act and then marry under the Christian Marriage Act in the Church.
  • Is this possible? What legal implication would be there if we wanted to do it that way?
  • Which one will become void if we get married the both ways? Do we have a choice to make a particular marriage certificate void?
  • What is the difference between Special Marriage Act and Christian Marriage Act? I mean are there any advantages and disadvantages for both male and female?
I would be very grateful if you could reply to my queries.
Dear Rosh,

Under the Law you can get married only under one i.e. Special Marriage Act or Christian Marriage Act and not both. In your case it would be appropriate if you get yourself married under the Special Marriage Act. If your wife is ready and willing to convert to Christian Religion then you could get married under the Christian Laws.
