Marriage rules

I am presently living in Darjeeling, where I have planned to marry a Nepali girl. As I am a Bengali, I wish to know the correct procedure to marry her via the marriage rules.
Dear Pulak,

You can definitely get married to your proposed spouse assuming you both are of marriageable age. You will have to visit the office of registrar of marriages situated in your jurisdiction and further apply for your marriage compliance and registration. Presumably, if you are getting married in India, you may get married and get your marriage registered under the Special Marriage Act, 1954

Presuming that you both are of a marriageable age, you can definitely get married to your girlfriend in India at the place where you reside. You will have to visit the office of registrar of marriages situated in your jurisdiction and further apply for your marriage compliance and registration. Also, you have to get your marriage registered under the Special Marriage Act, 1954. You may initiate the further process of obtaining the necessary permits and visa pertaining to your spouse after your marriage process is complied systematically.

Late marriage registration

I married 2 yrs back in the church. Now I need to register it in the court. What do I have to do? Whom do I have to meet or contact? How much do I have to pay and what documents and timings do I have to keep in mind?

You can definitely get your marriage registered at the place where you got married or reside permanently. You and your husband will have to personally visit the office of registrar of marriages situated in your jurisdiction and further apply for your marriage registration compliances on the basis of your church marriage. You will have to comply the required formalities by way of applying to the registrar of marriages and filling up the required form along with the necessary documents as required by the marriage officer.

As per the personal laws, the Registration requires certain civil formalities.

I got married in 2003, Kolkata. We didn't have our marriage registered then. Is it possible to have the registration now with registration date same as my actual social wedding date of 2003?
Dear Nitya,

You can definitely get your marriage registered by complying with the late fee / penalty charges stipulated officially by the office of marriage registrar. You need to know that the date of marriage would remain the same but only the registration date would be of that appropriate present day when you actually register your marriage. This cannot be dated back as the certificate of marriage registration and the office records bear the date of issuance of marriage registration certificate. It is always advisable to comply with all the procedures as per required laws.
