Arya Samaj marriage
Kavi asks,
I am planning to get married in an arya samaj mandir. My parents will be attending the marriage but the girl's parents will not. In this case do I need to have two witnesses and two references during the marriage? Can my parents themselves serve as two witnesses?
Dear Kavi,
You can definitely get married at the arya samaj mandir provided both of you are of legally marriageable age. Arya Samaj way of marriage is systematic and legally a valid way of getting married as per Hindu law and Vedic rites. Your parents can sign as appropriate witnesses at the time of your marriage at arya samaj mandir. You may personally contact the office of arya samaj for any further compliance and their regulations. Hope this answers your questions.
Different religion marriage
Tulika Das,
Can a Hindu girl marry a married Muslim man?
Dear Tulika Das,
A Hindu girl may marry any person professing Hindu or any other religion or caste as per law. But the said person with whom she proposes / intends to marry needs to be very clear in his status i.e. he should either be a bachelor or a divorcee. In case a Hindu girl intends to marry someone from a different religion, all legalities and procedures pertaining to the boy's religion, should also be complied with.
Visa for foreign citizen married an Indian
Nishant asks,
What kind of visa can be issued to a foreign citizen who has married an Indian citizen? Are there any specific provisions?
Dear Nishant,
You can definitely apply for the appropriate visa and the required permits for the necessary arrangements on the basis of the marriage to an Indian citizen. However, you have not mentioned the purposes, arrangements and the time duration you need for the visa. Different kinds of visas are issued for different purposes and for appropriate time durations depending upon the necessary arrangements and appropriate reasons. You may make necessary applications before the Indian authorities pertaining to necessary visas and permits. You will have to make the necessary applications before the Indian consulate and systematically comply with the required legal procedures. Hope this should suffice your query as sought in brief.
Threatened to kill
Ajay Mehta asks,
I love this girl and we are into a serious relationship. Her parents are against our marriage and they have hidden her somewhere since the last week. Her uncle is a PI and he has threatened to kill me. I even had to leave that place. Can you tell me the legal way to tackle this, as I want to marry her? We both are well educated and well settled.
Dear Ajay Mehta,
You can marry this girl provided you both are of legally marriageable age and both are consenting for the said marriage without any force or threat. Presuming that both of you are Hindus, you may get married as per Hindu Vedic rites and then get your marriage registered or you may get married before the office of the Marriage Registrar at the place of the jurisdiction where you both or either of you reside. You may file a written complaint at the nearest police station that shall help you to find the girl. Else you may directly file a complaint before the magistrate against her parents for confinement of the girl by approaching the appropriate Magistrate's court at the place of jurisdiction where you reside.
