Disclosure In Martial Status

Sneha asks,
I am a divorcee with a child. Recently got married to a green card holder. My daughter and I applied for a visitor visa thinking that it would be the fastest way to go to my husband in the US. But it got rejected. I had not disclosed my married status in the application. Can you help me with the right type of visa? (Dependent visa takes more than 1.5 years).

You are guilty of fraud and misrepresentation in not disclosing your marital status. This is likely to come in your way in obtaining an immigrant visa of USA. You should ask your husband to file an immigrant petition for yourself and name therein your child as a dependant under family 2ndA Preference category. It may take few years to receive an immigrant visa under the said petition. You may otherwise qualify to receive other category of visa. It would be advisable for you to explore those avenues.

Prohibition On Marriage

I am an Indian citizen and has been visiting! UK and USA I have a valid 10 yrs visa for USA granted in Dec 2005. I did not visit USA in 2008 and till now in 2009. I am divorced since 2007. Can I marry in USA while on a visit and can I apply for the green card thereafter. How can you help and what are your charges for the entire help and assistance.

There is no prohibition to a foreigner marrying in USA whilst they're on a visitor's visa. But as to whether after marrying someone in USA can that visitor apply for Green card would depend upon may factors including whom you are marrying.
