Yes you can file for divorce in USA. Your husband would be eligible to stay in USA as your dependent till the decree for divorce is passed. Once the relationship comes to an end he will have to return to his home country. The dependent visa will come to an end.

In addition to the Arya Samaj wedding certificate, Immigration authorities in USA as well as the consulate in India would also insist upon a Marriage Registration Certificate issued by the Registrar of Marriages of the place where the marriage has taken place.
