Problem in receiving J-1 visa

Yogi asks,
I am a doctor and have been in the US on B-1/ B-2 visa for 10 years to take medical examinations. I got married to an Indian holding H-1 visa in the USA (I-140 approved) 4 months back. I came back to India and got a job on J-1 visa in USA, I plan to get stamped this month. What are the types of questions or problems I may face?
Dear Yogi,

You may find it difficult to receive a J-1 visa since you are married to an H-1 visa holder and your marriage took place when you were in the USA on a visitor's visa. A J-1 visa applicant is required to show non-immigrant intention and strong family and financial ties in India. You should consult an advocate well versed in USA Immigration laws.

I am a green card holder and my son is getting married in August. I want my mom and my divorced sister to come an attended the wedding from Pakistan. What papers do they require to put in; also they don't have properties or bank accounts. I will send them the required papers from my side. Your mother and divorced sister may find it difficult to receive a visitor's visa to attend your son's wedding. An applicant of a visitor's visa is required to show non-immigrant intention, sufficient funds and strong family and financial ties in home country.

I am a green card holder. I got married in India and filed G-25 for my husband. Can he apply for H-1 visa? Will there be any problem?
Dear Priya,

If the job is genuine and if your husband has the requisite qualifications, he may apply for an H-1 visa. Even if he is married to you, the petition for his immigrant visa is pending.
